Terms and Conditions of Sale – BBEAUTYFY

ARTICLE 1 – Scope of Application
These Terms and Conditions of Sale apply to all sales concluded by ABD GROUP, a French simplified joint-stock company with a sole shareholder (SASU), hereinafter referred to as the “Seller,” with consumers and non-professional purchasers, hereinafter referred to as the “Customer,” through the website https://bbeautify.com, operating under the BBEAUTYFY brand.
They define the conditions applicable to orders, payments, deliveries, returns, refunds, and warranties for products offered for sale.
These Terms and Conditions are available on the website at all times. The version applicable to an order is the one in effect on the date the order is placed.
ARTICLE 2 – Products Offered for Sale
BBEAUTYFY offers, in particular:

Product photographs illustrate the items offered for sale. In the event of a discrepancy between an illustration and an essential characteristic expressly stated in the product description, the Customer's statutory rights remain applicable.
ARTICLE 3 – Product Availability
Offers remain valid for as long as they are displayed on the website, subject to stock availability.
If a product becomes unavailable after an order has been placed, the Customer will be informed and may obtain a refund of the amounts paid for the unavailable products, in accordance with applicable regulations.

ARTICLE 5 – Orders
5.1 Placing an Order
The Customer selects the desired products, adds them to the shopping cart, and provides the information necessary to complete the order.
Before final confirmation, the Customer can review the products, quantities, prices, any applicable shipping fees, and correct any errors.
The order is confirmed after payment has been validated and these Terms and Conditions have been accepted.
An order confirmation is sent to the email address provided by the Customer.
5.2 Order Modifications
For any modification request, the Customer must contact customer service at contact@bbeautify.com as soon as possible.
Modifications depend on the order's preparation and shipping status and cannot be guaranteed.
5.3 Order Cancellation
The Customer may request cancellation by contacting customer service.
If the order has already been shipped, the statutory right of withdrawal may apply.
These provisions do not affect the Customer's statutory rights.
ARTICLE 6 – Prices
Prices are displayed in euros (€), inclusive of all applicable taxes (VAT included where applicable).
Any shipping fees are displayed before the order is finally confirmed.
The total amount payable is presented to the Customer before confirmation.
BBEAUTYFY may change its prices at any time. Such changes will not apply retroactively to orders already confirmed.
ARTICLE 7 – Payment
Payment is made when placing an order, using the payment solutions available on the Shopify website.
The payment methods actually accepted are displayed during checkout.
Transactions are processed by the payment service providers used by the store.
The order is processed after payment has been validated.
ARTICLE 8 – Delivery
8.1 Shipping Destinations
Delivery is available to the destinations offered to the Customer during checkout.
8.2 Delivery Times
The applicable delivery dates or timeframes are communicated before the order is confirmed.
They may vary depending on the products, their availability, and the destination.
If no delivery timeframe has been agreed upon, delivery must take place no later than 30 days after the conclusion of the contract, unless otherwise agreed by the parties.
In the event of a delay, the Customer benefits from the rights provided under the applicable provisions of the French Consumer Code, including the possibility of terminating the contract under the conditions established by law.
8.3 Order Tracking
When tracking information is available, the Customer can monitor the shipment through the Order Tracking page.
8.4 Separate Deliveries
Depending on product availability or dispatch location, an order may be delivered in several packages.
8.5 Lost or Damaged Packages
In the event of loss, damage, or a delivery issue, the Customer is encouraged to contact BBEAUTYFY.
The Seller remains responsible for the proper fulfillment of its delivery obligations under the conditions established by law.
ARTICLE 9 – Transfer of Ownership and Risk
Ownership of the products is transferred to the Customer once the purchase price has been paid in full.
The risk of loss or damage transfers to the Customer when the Customer, or a third party designated by the Customer other than the carrier proposed by the Seller, takes physical possession of the products.
The statutory exceptions relating to a carrier independently chosen by the Customer remain applicable.
ARTICLE 10 – Right of Withdrawal
10.1 Statutory Withdrawal Period
In accordance with the French Consumer Code, the Customer generally has 14 days from receipt of the product to exercise the right of withdrawal without having to provide a reason.
For orders containing several items delivered separately, the withdrawal period generally begins upon receipt of the final item.
10.2 Exercising the Right of Withdrawal

10.3 Returning Products
After notifying the Seller of their decision to withdraw, the Customer has 14 days to return the products.
Products must only be handled to the extent necessary to establish their nature, characteristics, and proper functioning.
The Customer may be held liable for any reduction in value resulting from handling beyond what is necessary.

10.4 Exceptions to the Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, certain products may be excluded from the right of withdrawal.
This includes, in particular, goods that have been unsealed after delivery and cannot be returned for health protection or hygiene reasons, provided the legal conditions are met.
This exception does not automatically apply to all beauty accessories.
10.5 Refunds
In the event of a valid withdrawal, the Seller will refund the amounts due, including the original standard delivery charges under the conditions established by law, no later than 14 days after receiving notification of the withdrawal decision.
For the sale of goods, the refund may be withheld until the goods have been received back or until proof of their return shipment has been provided, whichever occurs first.
The refund will be made using the same payment method used for the original transaction, unless expressly agreed otherwise, and without any additional fees for the Customer.
ARTICLE 11 – Statutory Warranties and Seller Liability
Products sold benefit from applicable statutory warranties, independently of any commercial warranty that may be offered.
11.1 Statutory Guarantee of Conformity
The Customer benefits from the statutory guarantee of conformity provided for under Articles L217-3 et seq. of the French Consumer Code.
For the goods concerned, the Customer generally has two years from delivery of the product to exercise their rights.
The Customer may request repair or replacement of the product under the conditions established by law.
Where the statutory conditions are met, the Customer may also be entitled to a price reduction or termination of the contract.
Bringing a product into conformity is carried out at no cost to the consumer.
11.2 Warranty Against Hidden Defects
The Customer also benefits from the warranty provided for under Articles 1641 et seq. of the French Civil Code.
Where the legal conditions are met, the Customer may request cancellation of the sale or a reduction in the purchase price.
11.3 Product Use
Customers are encouraged to follow the instructions, manufacturer's recommendations, and safety precautions, particularly when using electrical devices and beauty tools.
These Terms and Conditions do not limit the Customer's statutory rights in the event of a defective or non-conforming product.
ARTICLE 12 – Personal Data Protection
ABD GROUP processes the personal data necessary to manage orders, payments, deliveries, and customer relationships.
Such processing is carried out in accordance with the General Data Protection Regulation (GDPR) and applicable French legislation.
Subject to applicable legal conditions, Customers have rights of access, rectification, erasure, restriction of processing, objection, and data portability.

ARTICLE 13 – Intellectual Property
The content of the BBEAUTYFY website, including text, photographs, illustrations, logos, and graphic elements, is protected by applicable intellectual property rights.
Any unauthorized reproduction or use of protected content is prohibited unless prior authorization has been obtained from the rights holder or an exception is provided by law.
ARTICLE 14 – Unforeseen Changes in Circumstances
Situations involving an unforeseeable change in circumstances are governed by applicable legal provisions, particularly Article 1195 of the French Civil Code, where its conditions are met.
ARTICLE 15 – Force Majeure
Neither party shall be held liable for failure to perform an obligation resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code, under the conditions established by law.
ARTICLE 16 – Applicable Law and Language
These Terms and Conditions are governed by French law, without prejudice to any mandatory consumer protection provisions that may apply in the Customer's country of residence.
They are drafted in French.
In the event of a translation, the French version shall serve as the reference version, subject to any applicable mandatory legal provisions.

In accordance with the provisions of the French Consumer Code, the Customer may use a competent consumer mediator free of charge after submitting a prior written complaint to the Seller, under the conditions established by law.

If an amicable resolution cannot be reached, the competent courts shall be determined in accordance with applicable legal rules.
ARTICLE 18 – Pre-Contractual Information and Acceptance
Before placing an order, the Customer can review the essential characteristics of the products, prices, any additional charges, delivery information, and these Terms and Conditions.
Confirming an order entails an obligation to pay and acceptance of these Terms and Conditions through the checkout process provided on the website.
The mandatory statutory rights of consumers remain applicable.
APPENDIX 1 – Information on Statutory Warranties
Products sold on BBEAUTYFY benefit from the statutory guarantee of conformity and the warranty against hidden defects.
